Bascue that he protect my Prytulak-Reply-D3 from suppression or destruction appears to have gone unheeded, as Prytulak-Reply-D3 was delivered to the court by FedEx on 07-Nov-2002 08:53AM, and as of 14-Nov-2002 10:44AM, has not yet made an appearance under Documents Filed in the Case Summary for BC271433 on the Los Angeles Superior Court web site (the red entry inserted by me indicates where the filing should have been acknowledged, but was not):

More telling than that, a Plaintiff document (shown in blue above) filed 12-Nov-2002 � five days after the missing Prytulak-Reply-D3 should have gotten filed � has been acknowledged in the Case Summary.

The appearance is that the Los Angeles Superior Court has not abandoned its policy of suppressing or destroying Defendant Prytulak submissions (not to mention one Plaintiff Rambam submission which was helpful to the defense), and has not been awakened to the realization that proceedings cannot be considered adversarial when one of the parties is largely excluded from participating.

As in the Court administration you are closer to Rambam v Prytulak than is Judge Bascue, I wonder if you could put a stop to the spoliation of its trial record where Judge Bascue could not, and I wonder if you could win a restoration to the trial record of all missing documents, whose number has now reached six:

If intervening in document destruction exceeds your authority, then I wonder if the dual benefits of preventing a miscarriage of justice in Rambam v Prytulak, and protecting the Los Angeles Superior Court from further loss of repute, could not be achieved by calling in outside law enforcement investigators, perhaps under California Penal Code section 135:

§135.  Every person who, knowing that any book, paper, record, instrument in writing, or other matter or thing, is about to be produced in evidence upon any trial, inquiry, or investigation whatever, authorized by law, willfully destroys or conceals the same, with intent thereby to prevent it from being produced, is guilty of a misdemeanor.
