Of potential relevance to the letter below are the following two sections from the California Penal Code:
§132. Every person who upon any trial, proceeding, inquiry, or
investigation whatever, authorized or permitted by law, offers in
evidence, as genuine or true, any book, paper, document, record, or
other instrument in writing, knowing the same to have been forged or
fraudulently altered or ante-dated, is guilty of felony.
§135. Every person who, knowing that any book, paper, record,
instrument in writing, or other matter or thing, is about to be
produced in evidence upon any trial, inquiry, or investigation
whatever, authorized by law, willfully destroys or conceals the same,
with intent thereby to prevent it from being produced, is guilty of
a misdemeanor.

Re: Rambam vs Prytulak BC271433 before Judge James R. Dunn
Presiding Judge James A. Bascue:
Although I appreciate that the bulk of complaints that cross your desk may only be remediable by an appellate court, my own complaint is that my submissions to the Los Angeles Superior Court are being suppressed or destroyed, threatening to leave a trial record too expurgated to support an appeal. If the suppression or destruction of litigant submissions is not a matter for the senior Court administration, then perhaps it is a matter for the police but it is a matter that calls for some immediate action, and that will not go away upon being ignored.
In jeopardy at the moment is my submission dated 05-Nov-2002, which I expect to be delivered to the Court, as well as served on Plaintiff lawyer Gary Kurtz, by FedEx on 07-Nov-2002, and which is currently available online at www.ukar.org/temp/rep05nov.html. I ask you to personally ensure that Executive Officer/Clerk John A. Clarke faithfully files and preserves this Prytulak submission in compliance with CCP §1952, §1952.2, and §1952.3 so that it will be available as part of the trial record in case of appeal.
I call to your attention, furthermore, that however appreciated might be the termination of continued document tampering, it does not constitute a complete redress of my grievance. A complete redress must include a restoration, and an account of, missing submissions and filing fees, as well as the bringing to justice of any who may have been guilty of misconduct. Remaining to be incorporated into the trial record, then, are the following five documents, all currently available online at the URLs shown, but none being listed under Documents Filed in the Case Summary for BC271433 on the LASC web site:
Until the Los Angeles Superior Court files the five above documents as "Correspondence Received" where they do not satisfy requirements as formal motions and until the Court holds these documents available for review by an appellate court, the trial record for Case BC271433 must be considered incomplete, and Defendant Prytulak's position must be recognized as having been compromised by behavior which possibly falls within the realm of the criminal. Return of the two missing money orders wouldn't hurt either.
Lubomyr Prytulak
