Justice would not be served by your elevation to the Federal Court, and it would be in the public interest for you to withdraw your candidacy, for the sufficient reason below.
James R. Dunn, working within the Civil Division of which you are Supervising Judge, has usurped power, as evidenced by his having to date spoliated six litigant submissions. If extrapolation can be trusted, James R. Dunn will go on to spoliate the seventh which was delivered to the Court this morning.
The immediate motive behind James R. Dunn's spoliation is to cover up his error of having refused to consider the question of his own jurisdiction over the interval of eight months.
I comprehend the principle that one judge does not intervene in what another judge at the same level is doing, but I see no bar to intervention in coram non judice proceedings, as these are not judicial proceedings and they are before a person not a judge, and in any case the intervention that is called for concerns the concealment or destruction of documents, behavior which is criminal and which no one is able to mistake for judicial.
You have been repeatedly notified of James R. Dunn's usurpation of authority, and you have failed to either stop it, or to indicate that it is worthy of your notice. It is unclear under what heading your shortcoming falls � perhaps it is corruption, perhaps incompetence, perhaps cowardice. Whatever the heading, your deficit is fatal, and disqualifies you from high public office, and certainly from the position of judge, not only within the appellate court to which you aspire, but also within the trial court on which you presently sit.
