Dear Ms Gusella:
Although I informed Ms Kessie Joseph in our telephone conversation of 29-Jan-2004 of my intention to not proceed with my complaint of the hate messaging which the Canadian Jewish Congress (CJC) publishes on its web site, she did not ask, and I did not volunteer, the reasons for my withdrawal. I do have two reasons which I now bring to your attention.
In the first place, my exposure to the CHRC has left me with a reasonable apprehension of bias, as I have explained in my three letters to you of
- 20-Dec-2003 Concerned About Richard Warman,
- 09-Jan-2004 Urgent call for disclosure of usage statistics and personnel data, and
- 13-Jan-2004 Muslims are targets of hate propaganda too.
And in the second place, I decline to complain to the CHRC because the CHRC will not read my demonstration that the CJC statements complained of are false; just as I reject the CHRC's authority to prosecute me for my own statements which I can demonstrate to be true. I find the CHRC demand for a removal from consideration of the truth of complained-of material to be both odious and dangerous. If a hurtful statement is knowingly false, then this has traditionally been taken as the chief evidence that its motivation is hatred; but if it is demonstrably true, then it has traditionally been inferred that its chief motivation is the furtherance of truth, a furtherance which is ever in the public interest, and which contraindicates a search for any supplementary motivation such as hatred. Discarding this traditional construction is putting Canadians on notice that their hard-won and dearly-cherished freedom of speech has been lost, and that they must henceforth begin to fear being jailed for speaking any truth capable of displeasing someone in power. Deviating from the law's traditional protection of truthful utterances is removing a pillar of Western Civilization and is embarking on a course which starts with persecution and which ends with Stalinism.
The above, then, are my two reasons for not complaining to the CHRC of CJC anti-Ukrainian hate messaging. As the many Canadians who also avoid the CHRC may do so for similar reasons, then the majority of Canadians may be hypothesized to be boycotting the CHRC because they view the CHRC as discriminatory and partisan, and because they shrink from legitimizing an institution which labors to establish its right to punish truth.
In short, I do not complain to the CHRC of Canadian Jewish Congress hate messaging because I join the boycott.
