HARASSING TELEPHONE CALLS   Canadian Criminal Code § 372(3)  Every one who, without lawful excuse and with intent to harass any person, makes or causes to be made repeated telephone calls to that person is guilty of an offence punishable on summary conviction.
CRIMINAL HARASSMENT   Canadian Criminal Code § 264(1) No person shall, without lawful authority and knowing that another person is harassed or recklessly as to whether the other person is harassed, engage in conduct referred to in subsection (2) that causes that other person reasonably, in all the circumstance, to fear for their safety or the safety of anyone known to them.

(2) The conduct mentioned in subsection (1) consists of

     (a) repeatedly following from place to place the other person or anyone known to them;

     (b) repeatedly communicating with, either directly or indirectly, the other person or anyone known to them;

     (c) besetting or watching the dwelling-house, or place where the other person, or anyone known to them,
           resides, works, carries on business or happens to be; or

     (d) engaging in threatening conduct directed at the other person or any member of their family.

(3) Every person who contravenes this section is guilty of

     (a) an indictable offence and is liable to imprisonment for a term not exceeding ten years; or

     (b) an offence punishable on summary conviction.

The telephone call that I received on the morning of 21-Apr-2004 at around 06:05 AM Vancouver time (09:05 AM in Toronto) was represented as having been made on your behalf to explain why you hadn't responded to my Why no reply? query of 07-Apr-2004.

PRYTULAK:  Hello.

CALLER:  Hi, I'm calling on behalf of Ed Morgan?

PRYTULAK:  Oh yes.

CALLER:  Yes, I'm  ...  Just a response as to why he hasn't been responding to you.

PRYTULAK:  Yes.

CALLER:  Because you're a fucking lunatic moron!

PRYTULAK:  Is that the reason?  [Caller's faint hang-up click punctuates the end of the preceding sentence, and possibly signifies that he began to hang up following his statement without waiting to hear any reply]  Who are you?  [Prytulak pauses, then hangs up too]

Several questions arise.  Was this caller really telephoning on behalf of the imminent Canadian Jewish Congress National President � yourself � and with a message that the imminent President authorized?  Are you aware that even though the *69 Call Return feature (which tells the recipient the telephone number of the caller) was blocked, the telephone company can still trace the call?  Are you aware that the caller has a distinctive way of choking up with nervous laughter when he talks, which might make his voice particularly identifiable to his acquaintances, as you will be able to hear for yourself upon playing the MP3 file?  And is this to be the complete Canadian Jewish Congress reply to my correspondence, or is something more cerebral being drafted by way of supplement?

Over the course of four years, I have attempted to engage the Canadian Jewish Congress in dialogue on issues of public concern, and when the CJC this morning for the first time addressed me directly, it was only to hurl expletives.  But does the CJC imagine that a people who pride themselves on their intelligence will submit to being led by oafs?  What tactics are these but those of a child who annoys by giggling naughty words, and immediately runs away in shame?  Does the CJC hope to compensate its deficit of argument by harassment?

If that was you calling, or if it was your idea, or done with your knowledge, then you might do well to reconsider the advisability of assuming the National Presidency of the Canadian Jewish Congress on 13-Jun-2004 (which I see at www.cjc.ca/template.php?action=news&story=642 you intend to do) � as in that case you would have demonstrated that you are not up to the job, and that you are likely to drag the Canadian Jewish Congress into deeper disrepute.

And if that was not you calling, and you knew nothing about it at the time, then you will be able to quickly identify who it was, and you will want to reprimand and discipline that person, if only for making you appear loutish and ineffectual.

In either case, I would appreciate your identifying for me the person who woke me this morning in your name, and to no greater effect than to convince me of his ignorance.

Also, the anonymous call having been made in your name leaves you with the obligation to either accept or deny responsibility for it.  Silence is ever suggestive of guilt without repentence.

On Monday, 26-Apr-2004, 08:50 AM Vancouver time, a second anonymous call was received relating to Ed Morgan, this one from (718) 486-1234, the area code 718 covering Bronx, Brooklyn, Queens, and Staten Island.  The only person living in that area who comes to mind is Steven Rambam.  When occasion arises, a court order may be able to determine to whom this telephone number is registered.  The caller's voice is entirely different from the voice in the first Ed Morgan call above, and in fact seems affected, unnatural, and disguised, as if striving to avoid the easy recognition of the first caller that had been made possible by his having spoken naturally.  What was said:

CALLER:  Lubomyr!   [Mispronounced as something like "Lubimor"]

PRYTULAK:  Yes.

CALLER:  Hi!  Ed Morgan calls again.  How you doin' asshole?   [His brilliant plan now having come to fruition, the caller possibly hangs up here]

PRYTULAK:  What do you want this time?   [Pauses, then hangs up]

On Tuesday, 27-Apr-2004, 05:09 AM Vancouver time, the same number � (718) 486-1234 � rings.  I do not pick up.

At 05:12 AM, the same number rings again.  Again I don't pick up.

At 05:25 AM, the same number rings again.  I pick up and say "Hello!" twice.  Silence at the other end.

At 05:54 AM, the same number rings again.  I pick up.  What happened would be hard to transcribe, and must be heard to be believed.
