Dear Mr. Prytulak:

Thank you for your letters dated December 20, 2003 and January 9, 2004 addressed to the Chief Commissioner.  She has asked me, as Director of Investigations, to reply.

I have carefully reviewed the concerns you raise in your letters, and would like to offer the following comments.

Firstly, Mr. Richard Warman is not, as you state, the "CHRC lead counsel on Internet prosecutions.  I can also confirm to you that he has not been, and will not be, involved in the processing of file #20031527 in which you are the Respondent.

Secondly, your comments concerning Mr. Simon Wiesenthal are outside the purview of the Commission and it would therefore be inappropriate for me to comment.

Thirdly, with regard to your comments on Holocaust denial, you are welcome to make any submissions you wish to the investigator involved in the processing of the file in which you are the Respondent.  If you are seeking legal advice, you may wish to contact independent legal counsel.  If you need to obtain a referral to an appropriate lawyer in your area, your provincial bar association will be able to help you in this.  If you are unable to afford a lawyer, you may consider contacting your local legal aid clinic.

Fourthly, with regard to your allegation that Mr. Warman is using his public office inappropriately, I can confirm to you that Mr. Warman is not acting on behalf of the Commission on the matters you raise, dealing with personal legal actions or other individual claims, and it would therefore be inappropriate to comment further.

Finally, in response to the concerns you raise in you January 9, 2004 letter about whether the CHRC allocation of resources is equitable, I would like to assure you that every complaint received by the Commission is dealt with on a case by case basis, consistent with the principles of thoroughness and neutrality.
