Russia plan to blackmail Ukraine over nuclear fuel supplies

"I suspect that the real motive behind the U.S./European/Russian attitude towards Iran's nuclear program is not to preclude the development of nuclear weapons; it is to preclude the development of nuclear technology for the production of electricity outside of U.S./European/Russian control. The "West"/Russia are establishing a stranglehold on the world's oil and natural gas supplies; they appear to want to establish a similar stranglehold on nuclear fission reactor technology."

The article by Oksana Kosharna reproduced below, has prompted me to write another letter to Yulia Tymoshenko updating my views on the subject. The recent tremendous pressure on Iran (and now Ukraine) to abandon all attempts to develop nuclear fuel technology, indicates that the nuclear powers (United States, Britain, France, Russia) are determined to monopolize this technology and prevent any competition in this area. I suggest that the Kharkiv Institute of Physics and Technology (KIPT) has the expertise to implement a Ukrainian nuclear program and that Canada's CANDU reactor may be a suitable replacement for the existing VVER design.]

10/10/2009 Russia pressuring Ukraine over nuclear fuel supplies - paper

The Russian state-run nuclear energy company Rosatom has drafted a plan to become the sole supplier of nuclear fuel to Ukraine, a serious Ukrainian analytical weekly has written. Rosatom hopes to achieve this goal through political, diplomatic and economic pressure. If the Russian plan is implemented, Ukraine will be fully dependent on Russian technologies at least until 2100. Ukraine has been seeking to diversify nuclear fuel supplies, including by developing cooperation with the US-based company Westinghouse. The following is an excerpt from the article by Olha Kosharna entitled "Plan for 'compulsion' to cooperation" published in the influential Ukrainian analytical weekly Zerkalo Nedeli on 10 October 2009; subheadings have been inserted editorially:

Zerkalo Nedeli has raised to the issue of Ukrainian-Russian cooperation in the area of nuclear energy and the nuclear industry for two reasons.

First, on 2 October 2009 a contract was not signed between the National Nuclear Generating Company Enerhoatom and the Russian open joint-stock company TVEL for the supply of nuclear fuel for Ukrainian nuclear power plants after 2011. The Ukrainian delegation cancelled its visit at the last minute. As the Interfax-Ukraine agency reported, quoting its source in the Ukrainian cabinet, the sides were prepared to sign a document that day in Moscow. But at the very last minute the signing of the contract was postponed by the Ukrainian side till a November meeting between the prime ministers of Ukraine and Russia [Yuliya Tymoshenko and Vladimir Putin] within the framework of a sitting of the Council of Heads of Government of CIS Countries in Yalta.

Second, the editorial office has got hold of a unique document entitled "Plan of measures of the state corporation Rosatom in relation to Ukraine after 15 July 2009 in the event of the non-signing of a long-term contract for supplies of fuel after 2010", the text of which, we are sure, is of interest to the Ukrainian public.

Ukrainian-Russian nuclear cooperation started was given a boost last spring. At a news conference following the completion of the work of the fourth sitting of the committee for economic cooperation of the Ukrainian-Russian interstate commission of 29 April 2009, Tymoshenko said agreement had been reached under which by 15 July "we will draft and submit for discussion a long-term contract for 10 years, including full-fledged development in all areas of cooperation in the sector of nuclear energy. This is important, because Ukraine hopes that a plant will be built jointly with Russia to produce nuclear fuel. We hope that in the near future we will be participants in an international centre for enrichment of uranium. And we know that Russia supports us in these important areas." It was also a matter of the joint construction of the third and fourth reactors at the Khmelnytskyy nuclear power station.

Later it became known that, when concluding the long-term contract for the supply of nuclear fuel for Ukraine's nuclear power stations after 2011 for 12 generators, the Russian side placed a condition of purchase by the Ukrainian side starting from 2011 of the whole volume of services for uranium enrichment in Russia. In that case, the Russian Federation was prepared to ensure its participation in the construction of a plant for producing nuclear fuel in Ukraine. It was presumed that the enterprise would be commissioned in time to provide the first fuel loads to generating sets No 3 and No 4 at the Khmelnytskyy nuclear power station, which it is planned to be commissioned in 2015-16.

Excerpts from Russia's plan

As far as can be judged, these accords with the Ukrainian prime minister suited the Russian side, and so the Russians endeavoured to sign the documents as quickly as possible and were apprehensive that the event might not take place by the time indicated in the protocol. The reasons, as the Russian side sees them, are set out in the following quote from the preamble to the afore-mentioned plan.

"The issue of supplies of nuclear fuel having been transferred from the level of a business entity to the NSDC [National Security and Development Council of Ukraine], the administration of the president of Ukraine and the Cabinet of Ministers of Ukraine did not make it possible to reach an agreement on commercial conditions for a long-term contract and proceed to its signing.

"The president of Ukraine, V[iktor] A. Yushchenko, continues to insist on the diversification of nuclear fuel supplies and is also demanding measures for de-monopolization of the Ukrainian market by Russian suppliers.

"Things went so far that the Russian side was accused of attempting to get hold of the Ukrainian market of isotope uranium enrichment, in spite of the fact that the prime minister of Ukraine, Y[uliya] V. Tymoshenko, signed the protocol of the fourth sitting of the committee for economic cooperation of the Russian-Ukrainian interstate commission.

"The management of Enerhoatom is unofficially stating that a long-term contract will not be signed by 15 July this year, directives for signing will not be presented before the end of the election campaign in Ukraine (17 January 2010) and post-election battles may introduce the latest amendment. One can hardly expect the work on the contract to be concluded earlier than May-June next year."

The following excerpt from the text was intended to show to the leadership of the Russian Federation what efforts were made by Russian negotiators to carry out the instructions of their prime minister on the signing of the documents in the time frame indicated in the protocol.

"Within the framework of numerous rounds of negotiations, the Russian side proposed various options of compromise decisions on agreeing the commercial conditions of a long-term contract. In particular, there was a guarantee of accelerated construction of a plant to produce nuclear fuel in Ukraine on condition of long-term purchase of Russian fuel cassettes for all the 15 operating Ukrainian generating sets. TVEL did not object to the localization in Ukraine of production of fuel powder and tablets up to 2020 with the substitution of supplies of American fuel by the plant's fuel sets. They were prepared to provide pledges to build the plant in Ukraine with government guarantees of the Russian Federation in exchange for Ukrainian pledges of long-term purchase of Russian services for uranium enrichment."

Intergovernmental agreement

In protocol language, her [Tymoshenko's] consent to the demands of the Russians sounds not all that emotional, but extremely convincing. It should be noted that it is an intergovernmental document - the protocol of the fourth sitting of the committee for economic cooperation of the Russian-Ukrainian interstate commission of 29 April 2009, where in the section "In the area of atomic power engineering and nuclear materials" it was written in black and white: "The state corporation for nuclear energy Rosatom and the Ukrainian Fuel and Energy Ministry are to ensure the conclusion no later than 15 July 2009 of a long-term contract for the supply of nuclear fuel for Ukraine's nuclear power plants after 2010 should be signed". It also says: "The Russian side, on condition of the conclusion of a long-term contract for supply of nuclear fuel for Ukraine's nuclear power plants after 2010 for the 12 operational generators in Ukraine and purchase by the Ukrainian side in Russia, starting from 2011, of the entire volume of services necessary for Ukrainian nuclear power plants in uranium enrichment will ensure its participation in the creation in Ukraine of the production of nuclear fuel under Russian technologies by the time necessary for the first fuel loads for the third and fourth generators of Khmelnytskyy nuclear power plant.

"The state corporation for nuclear energy Rosatom and the Ukrainian Fuel and Energy Ministry are to continue work on projects for building nuclear power plants in Ukraine, the Russian Federation and in third countries.

"By 1 November 2009 a draft agreement should be drawn up between the government of the Russian Federation and the Cabinet of Ministers of Ukraine on cooperation in the construction of the third and fourth generators at Khmelnytskyy nuclear power plant on the basis of the Russian project VVER [water-cooled reactor]-1000/V-392."

It is no secret that on the nuclear market a struggle is being waged both at the level of direct producer firms and at the state level. Moreover, monopoly states use not only economic, but also political levers of pressure intended to strengthen the position of their own producers. Russia in this sense is no exception, even though it regularly accuses Ukraine of politicizing the issue of providing Ukrainian nuclear power plants with nuclear fuel. The action plan quoted is a clear illustration of this.

It is noteworthy that this document was developed and approved by the middle of June 2009, when negotiations were still in full swing regarding the parameters of the future contract. I draw your attention to the fact that this plan was developed not in relation to Enerhoatom, which was due to sign the contract, but in relation to the Ukrainian state. One can only envy such a systemic approach to the defence of national interests, since I doubt that it could have entered anyone's head in Ukraine to develop and approve an action plan with regard to Russia in the event of its raising all sorts of conditions connected with the contract. And indeed, how in principle can this be carried out in conditions of a permanent election campaign and given a different understanding by the current president and prime minister of national interests? This is not even to mention that every subsequent government of Ukraine, returning from opposition, considers its sacred duty to amend the energy strategy of Ukraine up to 2030 to ensure that it is suitable for use by the business groups of fellow-party members.

Russia's national interests spelt out

What are the national interests of the Russian Federation in this area, which should be defended by the plan? I quote: "In this connection, the actions of the Rosatom state corporation in relation to Ukraine after 15 July 2009 should be aimed at:

1. Squeezing Westinghouse out of Ukraine and impeding its return to the fuel market of water-cooled reactors.

2. Restricting the possibilities of Ukraine to create a reserve of nuclear fuel from deliveries in 2010.

3. The choice by Ukraine of Russian technologies for the construction of nuclear fuel production.

4. Signing a long-term contract up to 2020 to connect Ukraine's nuclear fuel market to the Russian supplier in the form of firm guarantees for at least 12 generators.

5. The creation of conditions for the impossibility of direct purchases of SU (a separation unit is power essential to achieve the established level of uranium enrichment. The amount of SU directly depends on the volume of energy required by an enrichment installation - O.K.) via the open joint-stock company Tekhsnabeksport is providing SU contracts only in the framework of complete supplies of fuel via TVEL or spot purchases of SU in the composition of (?operational direction of production) via the open joint-stock company IUEC [International Uranium Enrichment Centre], and deliveries via Tekhsnabeksport only in extreme circumstances.

The most prompt and effective solution of tasks may be achieved by:

1. Conducting a complex of measures involving the political resources of Russia.

2. Removal of TVEL from the negotiation process before the transfer of the question of signing a long-term contract on to the commercial level and the exertion of additional pressure on Ukraine by stepping up cooperation with other foreign partners and global players on the world market of nuclear fuel.

3. Pressure on the Ukrainian side through commercial instruments, including the question of using uranium of Ukrainian origin in the manufacture of heat-emitting assembly.

4. Coordinated policy of affiliate and dependent firms of Atomenergoprom [Atomic energy industry] on issues of supplying Ukraine with complete fuel and its components.

5. Publication and circulation in the Ukrainian, Russian and foreign media of comments by experts and politicians about the reasons for the latest disruption to the time frame for signing a long-term contract and a document on the creation in Ukraine of nuclear fuel production."

Ukraine - rich source of profit from nuclear fuel

Why is Ukraine so important for the Russian Federation in this area?

In Ukraine there are 15 Soviet-design water-cooled nuclear reactors in use. This is the biggest pool of such reactors outside Russia, which, as is known, has declared itself to be the successor of the USSR.

Whereas in the Russian Federation there are nine VVER-1000 reactors in use and six reactors of the VVER-440 type, in Ukraine there are 13 V VER-1000 units plus two reactors of the VVER-440 type. As it was written in the report of the TVEL company for last year, its earnings for 2008 from supplies of nuclear fuel for nuclear power plants of Ukraine and Armenia (only one generator is in use there with a VVER-440 reactor) amounted to 15.944m roubles (34.4 per cent of overall earnings). Exactly the same amount was obtained from supplies to all the Russian nuclear power plants with a total number of 31 generators, including reactors of another design. This means that with a number of generators double the number of Ukrainian ones, TVEL obtains on the internal Russian market the same amount of money in a year as from Ukraine.

For an illustration of the significance of the Ukrainian market, it will not be superfluous to quote some other figures as well. The sale of nuclear fuel by TVEL to nuclear power plants in Eastern Europe and Lithuania in 2008 provided 21.2 per cent of the earnings, to Chinese nuclear power plants - 2.7 per cent, to Indian nuclear power plants - 5.7 per cent and to Iranian nuclear power plants - 1.7 per cent. If we compare these figures, it turns out that Ukraine accounts for half of the hard currency earnings of the Russian TVEL.

It is understood that the basic task of the Russian side is to keep the huge market of Ukrainian nuclear fuel to itself by any means, by squeezing out its rival, Westinghouse Electric Company, whose main shareholder is Toshiba. As is known, the Westinghouse company in spring 2008 signed a contract with Enerhoatom for five years (from 2011 to 2016) to supply nuclear fuel for three VVER-1000 reactors at the South Ukrainian nuclear power plant.

Competition from Westinghouse unwelcome for Russia

At present the share of Westinghouse on the world market of nuclear fuel amounts to 26 per cent and that of TVEL to 17. So TVEL is aiming to win 30 per cent of the world nuclear fuel market by 2030. To achieve this, it is necessary not only to retain its existing markets, but also to multiply them taking account of the plans, for example, of Ukraine to build new nuclear reactors. Hence the intention of Russia to create conditions under which Ukraine, having chosen Russian technologies for a plant to produce nuclear fuel on its territory, as a consequence would build only reactors of Russian manufacture. In this case, Russian companies will entrench themselves in Ukraine virtually for ever, and we will be 100 per cent dependent on Russian technologies in nuclear power engineering at least until 2100. Monopolization, because of the absence of competition, leads to dictatorship of the producer's prices and the imposition of disadvantageous conditions for the consumer of goods and services. And the worst thing, as we found out from the "gas wars", in the event of political complications between our countries, the monopolist can "turn off the tap", for example, suspending supplies of nuclear fuel. And then our nuclear power plants, which produce almost 50 per cent of the electricity in Ukraine, will come to a halt. The country's economy will be destroyed and Ukrainian citizens will be forced to use the experience of their ancestors in using torches to light their homes.

Ukraine's national interests in this sphere are clearly inscribed in the energy strategy up to 2030, approved by the government in spring 2006. Primarily this is getting rid of the 100 per cent dependence on the Russian monopoly supplier of nuclear fuel to existing Ukrainian nuclear power plants, i.e. diversification of the sources of fuel supplies. In order to achieve this aim, in 2005 a project was started to classify nuclear fuel produced by the Westinghouse company (its experimental industrial use) and a commercial contract was signed with it in 2008.

Second, there is diversification of reactor technologies for the new construction of nuclear generators in Ukraine, which also implies the use for them of fuel of a different design and a different supplier. For this, negotiations were started with the biggest suppliers of reactor technologies - companies from South Korea and Canada; with Westinghouse and the French AREVA.

Third, elements of a nuclear fuel cycle are needed to meet 100 per cent of the demand of our nuclear power plants for uranium and zircon alloys necessary for the production of nuclear fuel with the condition of buying services for isotope enrichment of uranium on world markets. The construction on the territory of Ukraine of a plant to produce nuclear fuel is also being examined as a way to diversify sources of fuel supplies.

Russia resorting to underhand tricks

Being aware of this, the Russians propose: "In implementing the plan, special attention should be paid to the fact that:

"A long-term contract and opposition to the construction in Ukraine of a plant using Westinghouse technologies, regardless of the strategy and tactics of further actions, should remain the priority tasks of the Russian atomic industry in Ukraine. The extent of the further presence of the Rosatom state corporation on the Ukrainian and European markets will directly depend on their fulfilment. Otherwise, the situation will allow the American Westinghouse company to entrench itself in Ukraine and also to create a good springboard to return to Europe, where losses for the Russian atomic industry may be considerable."

In order to expand its possibilities of getting access to uranium enrichment services, the Ukrainian government took the decision to join the work of the IUEC in Angarsk in Russia. The activity of this centre, as was proudly declared by the Russian side, will be implemented under the aegis of the International Atomic Energy Agency (IAEA) and guarantee the access of member countries to the enriched uranium necessary for the production of nuclear fuel for their nuclear power plants.

It turns out that the Russian Federation and Ukraine have a common task (q.v. the epigraph) only in one area - each one's defence of their own national interests when developing domestic nuclear power engineering and atomic industry complex. But national interests here do not at all coincide and even to a large extent, as they say, are conflicting.

The Russians are using the most varied methods of defending national interests, moreover in all areas: from "switching on the political resource of Russia", as it was elegantly written in the above-mentioned plan, to switching on marginal pro-Russian parties in Ukraine, even though that is not directly mentioned in the "action plan... [ellipsis as published] on non-signing.. . [ellipsis as published]". From pressure on Ukraine through commercial instruments and the authority of the EU to the blackmail of withdrawing from negotiations and ostentatious activation of them with other states on the construction of a plant to produce nuclear fuel. And, of course, the publication and circulation in Russian, Ukrainian and other media of comments from politicians and experts that Ukraine was to blame for the disruption of the time frame for signing the contract between Ukraine's Enerhoatom and Russia's TVEL.

The authors of the plan who will subsequently implement it were not averse to using improper methods. For example, spreading information that using fuel produced by Westinghouse would lead to a new Chernobyl. Or launching "canards" in the media that the decision had already been made in the Ukrainian presidential secretariat on locating the plant to make nuclear fuel next door to Bila Tserkva, where not that long ago there were instances of unrest by residents regarding the location of another industrial facility. The arsenal of methods also includes the organization of all sorts of protest rallies using Ukrainian citizens.

"The critical point for Rosatom is 2015, when it is estimated that Ukraine will take the final decision on further work with the American company. It is very important to overcome that year within the framework of long-term cooperation. The limitation of the time frame of the contract to 2015 will facilitate the creation of comfortable conditions for Westinghouse expansion on the water-cooled reactor market. It is necessary to take into account the fact that at approximately the same time it is expected that new separator enterprises in Europe and the USA will reach rated capacity (or at least the commissioning of the first stages). The surplus of production capacities, the excess of supply over demand and the absence of a long-term contract for complete deliveries may lead to Ukraine carrying out long-term diversification of supplies of services for isotope enrichment of uranium."

This is a quote from the "Action plan of the state corporation Rosatom in relation to Ukraine after 15 July 2009 in the event of the non-signing of a long-term contract for supplies of fuel after 2010". Ideally, a contract with TVEL for the supply of nuclear fuel for Ukrainian nuclear power plants should have been signed by Enerhoatom for the period 2011-2015. Originally the Russians were proposing time frames for the contract from 2011 to 2016. According to the latest information, a compromise was found - the time frame of the contract is restricted to 2020. And if the time frame of the contract stay the same, then it will be possible to congratulate the Russians on achieving one of their goals.

Nuclear fuel set to be buyer's market by 2015

For the Russian Federation it is important to overcome the fateful 2015 within the framework of long-term cooperation with Ukraine, which was noted in the document. This is exactly the year that will be the frontier, when Ukraine will take a decision about the industrial use of fuel assemblies of Westinghouse manufacture to complete the four-year time frame of experimental use of 42 fuel assemblies and the passage of permission procedures in the State Committee of Nuclear Regulation of Ukraine. This means that a real chance will appear that Ukraine will obtain a second supplier of nuclear fuel for its nuclear power plants, and the aim posed in the Energy Strategy to diversify sources of supplies will be achieved.

It is also a matter of the fact that by 2015 additional capacities are due to be commissioned for uranium enrichment in France and the USA, and Ukraine will be able to buy these services on the world market for the enrichment of domestic uranium extracted, since supply of that service, as the authors of the Russian plan rightly note, will exceed demand by that time, and the price for enrichment may substantially fall because of competition on the market of those services.

Up to the present day all uranium enrichment services have been bought by Enerhoatom only in the Russian Federation, including uranium enrichment on a commercial basis for the 42 fuel assemblies of Westinghouse production that are already located in Ukraine. Therefore it is not surprising that the aim of the notorious plan also include "the creation of conditions for the impossibility of direct purchases" of services for isotope enrichment of uranium via Rosatom's affiliate company, Tekhsnabeksport. It was strictly stipulated that supplies to Ukraine would be only in the form of ready fuel assemblies, i.e. complete deliveries and only via TVEL. This time the Russians do not want to permit competition between their own companies on the Ukrainian market, since Tekhsnabeksport at one time won a tender for the enrichment of Ukrainian uranium necessary for making the above-mentioned fuel assemblies of Westinghouse production. It is advantageous to the Russian Federation to sell output of a higher technological re-division, i.e. ready fuel assemblies via TVEL.

Ukraine's bid to join IUEC stalled: Kazakhstan blamed

In this connection, it is also noteworthy that in spite of all the formal steps undertaken by Ukraine to join the IUEC, a decision concerning this has still not been taken, although almost 10 months have already passed since the relevant Ukrainian note. The Russian side is putting the blame on Kazakhstan, the third participant in the IUEC. But there are grounds for assuming that it is precisely at the request of the Russian Federation that Kazakhstan can still in no way "give approval" to Ukrainian participation in this project.

It is very advantageous to Russia to have Ukraine in a "suspended" state in this matter, in order, for example, to raise conditions on the purchase of the entire volume of services for uranium enrichment from it alone from 2011 and for at least the subsequent 10 years.

But there is a nuance. Since Russia initiated the creation of the IUEC and is very proud that it is the first member state of the IAEA to carry out so-called multilateral approaches to stages of the nuclear fuel cycle, which are sensitive from the viewpoint of nuclear weapons proliferation proposed at one time by the IAEA, it will look somehow not good in the eyes of the international public if the Russian Federation openly puts a brake on the process of Ukraine joining this project. It is better to have it done by other people's hands, which, after the arrest of the head of Kazatomprom [Kazakhstan atomic industry], M. Dzhakishev, proved to be not at all difficult, since now this Kazakh atomic company is headed by a man with kinship ties in the Russian atomic industry complex (V. Shkolnik is related by marriage to V. Zhinov, the leader of the Russian company Atomredmetzoloto [Atomic rare metals and gold], who, as the press writes, "completely by chance" is in charge of Rosatom's contacts with Kazatomprom).

Further areas of Russian pressure outlined in plan

Does Ukraine need to join this project if the Russian Federation intends to use it as an instrument of pressure? Potential partners of the project and the IAEA! Read the following quotation from the plan carefully:

"4.2. Informing the Ukrainian side about the business model of the IUEC:

- The IUEC is not a commercial organization providing services for uranium enrichment on long-term contracts;

- The IUEC is a guarantor of providing SU, which does not have its own production separation capacities, but has certain capabilities in the framework of quotas allocated for the marketing of annual spot orders.

4.3. After Ukraine joins the IUEC, providing Enerhoatom with the services of the IUEC in a volume that will not exceed the requirements for SU of three Ukrainian generators, manufacture [of fuel] for which will be implemented by a non-Russian supplier. The creation for Ukraine of the strictest possible conditions for acquiring SU in the composition of the IUEC - timely application to obtain services, world prices for uranium enrichment services. Direct supply of SU to Ukraine within the IUEC should be carried out only via the IUEC in view of a political decision on Ukraine's accession to the organization in question. Direct supplies of SU from Tekhsnabeksport to Ukraine should be regarded as the worst possible option."

Threat to involve Czech Republic

"Section 2. Measures connected with the withdrawal of TVEL from the negotiation process.

2.1. After informing the Ukrainian side about the withdrawal of TVEL from the negotiation process until the issue of providing Ukrainian nuclear power plants with nuclear fuel is transferred to a commercial basis, attention is to be focused at the negotiations with Czech partners on the question of locating a "pilot" regional plant in the Czech Republic and also on contacts with other foreign players on the world nuclear fuel market with the aim of creating additional areas of pressure on Ukraine.

The risks for Ukraine are not receiving sufficient fuel in 2011, a refusal to accept Ukrainian uranium for production of fuel assemblies until the signing of a long-term contract and an amendment to the time frame for commissioning the production of nuclear fuel.

The risks for Rosatom, Atomenergoprom and TVEL are the absence of a confirmed order for the purchase of uranium and services for enrichment and manufacture, non-fulfilment of the key effectiveness indicator in the section of formation of a portfolio of export orders for a five-year period, the likelihood of an expansion of the presence of Westinghouse in Ukraine for political reasons and the purchase of non-Russian uranium and SU for at least three generators.

Additional areas of pressure on Ukraine

2.1.1. Continuing negotiations with Czech partners on the construction of a plant to produce nuclear fuel under Russian technologies in the Czech Republic. Shedding light on the situation about the desire and possibility of the Czech side to locate assembly production of fuel assemblies under Russian technologies on its territory. Discussion of the question of the possibility of exerting pressure on the part of the European Union on Ukraine to get it to accept Czech production as an alternative producer and supplier of nuclear fuel. Working on the question of the possibility of compulsion of Ukraine on the part of the EU for the compulsory holding of tenders for the purchase of nuclear fuel.

2.1.2. With the return of the Russian side to the negotiation process with Ukraine on a long-term contract, by agreement with the Czech side, informing Ukraine that dragging out the negotiation process on its part has led to a definitive choice by us of the Czech Republic as a site for locating a "pilot" plant for the production of fuel under Russian technologies. We will propose to Ukraine to accept this plant as an alternative supplier of fuel for Ukrainian nuclear power plants. Discussing the question of purchase by Ukraine of fuel on a tender basis.

Negotiations with US companies to bypass Ukraine

2.1.3. Holding talks with Toshiba/Westinghouse on the question of the possibility of coordination in making fuel. Using cooperation between Atomenergoprom and Toshiba to organize a depository of the IUEC to start coordination with Westinghouse. Using factors of guaranteed provision of Toshiba/Westinghouse by the Russian IUEC in exchange for the withdrawal of the American company from the nuclear fuel market of Ukraine.

2.1.4. Holding meetings with GE on the question of coordination in the section of a joint business to advance fuel assemblies - Kvadrat on the American market. Using contacts as a threat to the positions of Westinghouse in the USA.

2.1.5. Holding talks with Siemens and using a strategic alliance for entering the American market with the aim of putting pressure on Westinghouse.

2.1.6. Considering the possibilities of using cooperation with the American company USEC for supplies of Russian services in uranium enrichment to put pressure on Westinghouse."

[This is a quotation from] "Action plan of the state corporation Rosatom in relation to Ukraine after 15 July 2009 in the event of the non-signing of a long-term contract for supplies of fuel after 2010".

There was a time when Mr V. Konstantin, one of the leaders of TVEL, used to say that Russia would only build plants for making nuclear fuel on foreign soil when the pool of Russian reactors in the world reached the figure of 90. And so far there are 74 of them in the world. But suddenly last autumn the TVEL company publicly formulated demands for the selection of a site for construction of a plant outside Russia's borders.

New criteria for selecting nuclear fuel production site

The site is to be selected on the basis of the following criteria that the countries have to comply with: the existence of a significant pool of reactors of Russian design, adherence in future to Russian technologies and equidistant from traditional Russian markets of output of the nuclear fuel cycle.

It seems that Ukraine meets the first announced criterion (maximum number of reactors outside the borders of the Russian Federation). As for the second one, so far as can be judged, the Ukrainian prime minister has assured her Russian counterpart of "adherence in future" to Russian technologies. It is only unclear what the third criterion means, since Ukraine today is a centre of marketing of output of the Russian nuclear fuel complex in terms of volume, and therefore cannot be "equidistant" from traditional Russian markets by definition.

In order to put pressure on Ukraine, the TVEL leadership in June-July started giving interviews to the media about the fact that "at least five countries have already expressed interest in building such plants. We are closely watching and are linking the definitive decision with the criteria that we have elaborated". The possible partners named include the Czech Republic (two generators with VVER-1000 reactors and four with VVER-440 reactors) and Slovakia (five generators with VVER-440 reactors). The others most likely were thought to be (but not named) Hungary (four VVER-440 type reactors) and Bulgaria (two generators with reactors of the VVER-1000 type). It is possible that for the round figure Finland was meant; it uses two generators of the VVER-440 type.

The problem is that those countries primarily use Russian reactors of the first generation, which will soon be decommissioned. And the fuel assemblies for them differ from the fuel assemblies for VVER-1000 reactors, which the Russian Federation is actively promoting abroad. Something here does not match up with the declared criterion on the number of generators of Russian design, especially of the latest generation. All this talk about a queue of those wanting to build the plant is pure bluff and huffing and puffing.

And it seems to Ukrainian experts that, on the strategic level, construction of a plant to produce nuclear fuel will be more promising for the future of nuclear power engineering in Ukraine in partnership with the Westinghouse company.

Russian threats to Ukraine

Today's careful position of Westinghouse concerning cooperation in building a plant to produce nuclear fuel in Ukraine can be explained only by the successful implementation of the points mentioned in the Russian plan (the time frame for implementation was planned for July-August 2009).

Well, and of course the arsenal of instruments of pressure on Ukraine contains a set of threats: not supplying nuclear fuel after 2011; creating conditions to ensure that in 2010, in the framework of the terms of the old contract, Ukraine would be unable to create a stock of fresh fuel for use in 2011, for which 100 per cent prepayment is required 150 days prior to shipment; refusing to buy 200 t of Ukrainian uranium concentrate in 2009 and 2010 to create "maximum tough conditions" for acquisition by it (by Ukraine - O.K.) of services for uranium enrichment in the composition of the IUEC, namely: "timely application to obtain services and world prices for services".

I want to draw attention as well to such pearls contained in the document: "... [ellipsis as published] on the possibility exerting pressure on the part of the European Union on Ukraine to get it to accept Czech output as an alternative producer and supplier of nuclear fuel". Well there is also "concerning the possibility of compulsion (!) of Ukraine on the part of the EU for the mandatory holding of tenders when purchasing nuclear fuel".

One wonders in what way the EU will "compel" Ukraine to hold tenders for the purchase of fuel, if our national legislation has made an exception for purchases precisely for fresh nuclear fuel in view of its specificity as a product.

Judging by statements from the Ukrainian prime minister quoted at the beginning of the article, she supports the Russians in the comprehensive linkage of the question and is prepared for close cooperation in the nuclear industry on their conditions.

Ukraine's leaders split over Russian terms

The president of Ukraine, however, saw the Russian condition of purchase by Ukraine of the entire volume of services to enrich uranium as a threat of monopolization, which he spoke about on 5 June 2009 when opening a sitting of the NSDC devoted to developing the market of fuel and energy resources in the framework of implementing Ukraine's energy strategy. The president's decree, which put the NSDC decision into force, saw the light of day only on 27 August 2009. Such tardiness is hard to explain in the light of the complex negotiations, continuing all this time, important from the viewpoint of the future of the development of domestic nuclear power engineering.

The NSDC decision clearly formulated that when compiling contracts for supplies of nuclear fuel it is essential "to avoid accepting conditions that restrict Ukraine's possibilities for the diversification of sources of nuclear fuel supplies and monopolize individual services of the nuclear fuel cycle". Something new also appeared. The government was tasked "to consider the issue of creating an enterprise to produce nuclear fuel on a competitive basis taking account of existing proposals" by the end of 2009. Previously there was no question of a competition; there was talk only of the choice of partner.

Well, and the instruction to the government in this decision looks surprising: "To develop within one month (!) a draft intergovernmental agreement with the government of the Russian Federation regarding the development of cooperation in the area of prospecting, extracting and processing uranium ores directed at ensuring in the medium term future the extraction of uranium for completely covering the requirements of Ukraine's nuclear power engineering for uranium raw material."

What is up? How this instruction is combined with the president's apprehensions regarding monopolization by Russia of individual stages of the nuclear fuel cycle is probably known only to those who drew up the text of the decree. Why must the contract be signed precisely with Russia rather than with Kazakhstan, Canada or Australia, which after all are world leaders in the extraction and processing of uranium, and which create joint enterprises all over the world?

But before all this, dear readers, the presidential decree of 11 February 2009 saw the light of day, where it says in black and white:

"... [ellipsis as published] in spite of the successfully conducted negotiations under the leadership of the head of state with the American side and the signing of contracts with the Westinghouse company for supplies of nuclear fuel for three nuclear stations starting from 2011... [ellipsis as published]" Does this mean that our esteemed president acknowledged that he had encroached on the remit of the government of Ukraine and held talks on behalf of the Enerhoatom economic entity? Well, what can you say about that... [ellipsis as published]

And now, can you imagine how, given such a mess, to put it mildly, dominating the highest echelons of the Ukrainian authorities, an economic entity, namely the state enterprise Enerhoatom can properly conduct gruelling negotiations with its Russian partners, known for their skill and subtlety, and who, moreover, have an approved plan of "compulsion"? And at the same time strive to defend Ukraine's national interests?

План «понуждения» до співробітництва

«ДТ» звернулося до теми українсько-російського співробітництва в сфері ядерної енергетики та атомної промисловості з двох причин.

По-перше, 2 жовтня 2009 року не відбулося підписання контракту між НАЕК «Енергоатом» і російським ВАТ «ТВЕЛ» на поставку ядерного палива для українських АЕС після 2011 року. Українська делегація скасувала свій візит в останній момент. Як повідомило агентство «Інтерфакс-Україна», з посиланням на своє джерело в Кабміні України, сторони вже були готові підписати документ цього дня в Москві. Та буквально в останній момент терміни укладення контракту було перенесено українською стороною на листопадову зустріч прем’єрів України і Росії в рамках засідання Ради глав урядів країн СНД у Ялті.

По-друге, у розпорядженні редакції опинився унікальний документ під назвою «План мероприятий Госкорпорации «Росатом» по действиям в отношении Украины после 15 июля 2009 года при неподписании долгосрочного контракта на поставку топлива после 2010 года», текст якого, ми в цьому переконані, становить інтерес для української громадськості.

Події в цій сфері українсько-російського співробітництва стали активно розвиватися з весни. На прес-конференції після завершення роботи четвертого засідання Комітету з питань економічного співробітництва українсько-російської міждержавної комісії 29 квітня 2009 року Юлія Тимошенко заявила, що досягнуто домовленості про те, що до 15 липня «ми сформуємо та надамо для обговорення довгостроковий контракт на десять років, який включає повноцінний, за всіма напрямами, розвиток співробітництва в секторі ядерної електроенергетики. Це важливо тому, що Україна сподівається, що буде разом із Росією побудований завод з виробництва ядерного палива. Ми сподіваємося, що в найближчій перспективі ми станемо учасниками міжнародного центру зі збагачення урану. І ми знаємо, що Росія підтримує нас у цих важливих напрямах». Йшлося також і про спільне будівництво третього і четвертого енергоблоків Хмельницької АЕС.

Пізніше стало відомо, що при укладенні довгострокового контракту на поставку ядерного палива для АЕС України після 2011 року на 12 енергоблоків російська сторона висунула умову здійснення закупівель українською стороною починаючи з 2011 року всього обсягу послуг зі збагачення урану в Росії. У такому разі РФ готова була забезпечити свою участь у будівництві заводу з фабрикації ядерного палива в Україні. Передбачалося, що підприємство буде введене в експлуатацію до терміну, необхідного для забезпечення перших паливних завантажень енергоблоків №3 і №4 Хмельницької АЕС, які планується запустити в 2015—2016 роках.

Судячи з усього, російську сторону влаштовували ці домовленості з українським прем’єр-міністром, тому росіяни прагнули максимально швидко підписати документи й побоювалися, що до зазначеного в протоколі терміну подія може не відбутися. Причини, як бачить їх російська сторона, викладено в наступній цитаті з преамбули до вищезазначеного «Плану…»:

«Перенос вопроса поставок ядерного топлива с уровня хозяйствующего субъекта в СНБО Украины, Администрацию Президента Украины и Кабинет Министров Украины не позволил досогласовать коммерческие условия долгосрочного контракта и выйти на его подписание.

Президент Украины В.А.Ющенко продолжает настаивать на диверсификации поставок ядерного топлива, а также требует принять меры по демонополизации украинского рынка российскими поставщиками.

Дело дошло до того, что российская сторона была обвинена в попытках захвата рынка Украины по изотопному обогащению урана, несмотря на то, что Премьер-министр Украины Ю.В. Тимошенко поставила свою подпись под Протоколом четвертого заседания Комитета по вопросам экономического сотрудничества Российско-Украинской межгосударственной комиссии.

Руководство ГП НАЭК «Энергоатом» неофициально заявляет о том, что долгосрочный контракт не будет подписан до 15 июля текущего года, директивы на подписание не будут предоставлены до окончания предвыборной кампании в Украине (17 января 2010 год), а послевыборные баталии могут внести очередную корректировку. Вряд ли можно рассчитывать на то, что работа над контрактом будет завершена раньше мая—июня следующего года».

А наступний уривок тексту покликаний показати вищим органам РФ, яких зусиль було докладено російськими переговорниками для виконання доручення свого прем’єр-міністра про підписання документів у зазначений у протоколі термін.

«В рамках многочисленных раундов переговоров российской стороной предлагались различные варианты компромиссных решений по досогласованию коммерческих условий долгосрочного контракта. В частности, было гарантировано ускоренное строительство завода по производству ядерного топлива в Украине при долгосрочной закупке российских топливных кассет для всех пятнадцати действующих украинских энергоблоков. ОАО «ТВЭЛ» не возражало против локализации в Украине производства топливного порошка и таблетки до 2020 года при замещении поставок американского топлива тепловыделяющими сборками завода. Исполнение обязательств по сооружению завода в Украине были готовы обеспечить правительственными гарантиями Российской Федерации в обмен на обязательства Украины по долгосрочной закупке российских услуг по обогащению урана».

Не можу втриматися від коментарю з приводу того, що, попри офіційність документа і гриф «Для служебного пользования», у ньому є емоційна складова. Наприклад, фраза, яка починається словами «Дело дошло до того (!), что российская сторона была обвинена в попытках захвата рынка Украины по изотопному обогащению урана…», свідчить про багато що. Ну просто обурення звучить через несправедливі обвинувачення.

Однак насправді для України така загроза існує, про що йтиметься далі. Та можна зрозуміти й аргумент російської сторони щодо праведності їхнього гніву, адже «…Премьер-министр Украины Ю.В. Тимошенко поставила свою подпись под Протоколом четвертого заседания Комитета по вопросам экономического сотрудничества Российско-Украинской межгосударственной комиссии». Та-а-к, «здали» росіяни нашого прем’єра…

Протокольною мовою її згода з вимогами росіян звучить не так емоційно, але дуже переконливо. І потім, це ж міжурядовий документ — протокол четвертого засідання Комітету з питань економічного співробітництва Російсько-української міждержавної комісії від 29 квітня 2009 року, де в розділі «В области атомной энергетики и ядерных материалов» чорним по білому написано: «Госкорпорации по атомной энергии «Росатом» и Минтопэнерго Украины обеспечить заключение не позднее 15 июля 2009 года долгосрочного контракта на поставку ядерного топлива для АЭС Украины после 2010 года». А також: «Российская сторона, при условии заключения долгосрочного контракта на поставку ядерного топлива для АЭС Украины после 2010 года для 12 действующих в Украине энергоблоков и закупки украинской стороной в России, начиная с 2011 года, всего необходимого для АЭС Украины объема услуг по обогащению урана, обеспечит свое участие в создании в Украине производства ядерного топлива по российским технологиям к сроку, необходимому для первых топливных загрузок третьего и четвертого энергоблоков Хмельницкой АЭС.

Государственной корпорации по атомной энергии «Росатом» и Министерству топлива и энергетики Украины продолжить работу по проектам строительства АЭС на территории Украины, Российской Федерации и третьих стран.

До 1 ноября 2009 года подготовить проект Соглашения между Правительством Российской Федерации и Кабинетом Министров Украины о сотрудничестве в строительстве энергоблоков №3 и 4 Хмельницкой АЭС на основе российского проекта реакторной установки типа ВВЭР-1000/В-392».

Перпендикулярність національних інтересів

Не секрет, що на ядерному ринку конкурентна боротьба ведеться як на рівні безпосередньо фірм-виробників, так і на державному. Причому держави-монополісти застосовують не лише економічні, а й політичні важелі тиску, покликані зміцнити становище власних виробників. Росія в цьому сенсі не є винятком, хоча й регулярно обвинувачує Україну в політизації питання забезпечення українських АЕС ядерним паливом. Процитований «План мероприятий...» — яскрава тому ілюстрація.

Примітно те, що цей документ було розроблено і затверджено до середини червня 2009 року, коли ще на повну силу тривали переговори щодо параметрів майбутнього контракту. Звертаю увагу, що цей план заходів розроблено не щодо суб’єкта господарювання НАЕК «Енергоатом», який має підписувати контракт, а щодо держави Україна. Такому системному підходу з обстоювання своїх національних інтересів залишається тільки заздрити, оскільки сумніваюся, що комусь в Україні спало б на думку розробляти та затверджувати план дій стосовно Росії у разі висування нею різноманітних умов, пов’язаних із цим контрактом. Та й як це, у принципі, можна здійснити за умов перманентної передвиборної кампанії та при різному розумінні чинними президентом і прем’єром національних інтересів? Не кажу вже про те, що кожен такий уряд в Україні, який повернувся з опозиції, вважає своїм святим обов’язком так підкоригувати Енергетичну стратегію України до 2030 року, щоб вона була зручна у використанні для бізнес-груп однопартійців.

У чому полягають національні інтереси РФ у цій сфері та на захист чого спрямовані заходи згаданого плану? Цитую: «В этой связи действия Госкорпорации «Росатом» в отношении Украины после 15 июля 2009 года должны быть нацелены на:

1. Вытеснение Вестингауз с Украины и препятствие его возврата на рынок топлива ВВЭР.

2. Ограничение возможностей Украины по созданию резерва ядерного топлива за счет поставок в 2010 году.

3. Выбор Украиной российских технологий для строительства производства ядерного топлива.

4. Подписание долгосрочного контракта до 2020 года для фиксации рынка ядерного топлива Украины за российским поставщиком в объеме твердых обязательств не менее 12 энергоблоков.

5. Создание условий для невозможности прямых закупок ЕРР (одиниця розділювальної роботи — це кількість зусиль, які необхідні для досягнення встановленого ступеня збагачення урану. Кількість ОРР напряму залежить від обсягу енергії, яку споживає збагачувальна установка. — О.К.) через ОАО «Техснабэкспорт» — контрактация ЕРР только в рамках комплектных поставок топлива через ОАО «ТВЭЛ» или спотовые закупки ЕРР в составе ОУП через ОАО «МЦОУ», поставки через ОАО «Техснабэкспорт» только в крайнем случае.

Наиболее быстрое и эффективное решение задач может быть достигнуто за счет:

1. Проведения комплекса мероприятий с подключением политического ресурса России.

2. Выхода ОАО «ТВЭЛ» из переговорного процесса до перевода вопроса о подписании долгосрочного контракта в коммерческую плоскость и оказания дополнительного давления на Украину через активизацию сотрудничества с другими зарубежными партнерами и глобальными игроками на мировом рынке ядерного топлива.

3. Давления на украинскую сторону через коммерческие инструменты, включая вопрос об использовании при изготовлении ТВС природного урана украинского происхождения.

4. Скоординированной политики ДЗО ОАО «Атомэнергопром» по вопросам поставки в Украину комплектного топлива и его компонентов.

5. Публикации и тиражирования в украинских, российских и зарубежных СМИ комментариев экспертов и политиков о причинах очередного срыва сроков подписания долгосрочного контракта и документа о создании в Украине производства ядерного топлива».

Чому Україна настільки важлива в цій сфері для РФ?

В Україні експлуатується 15 атомних енергоблоків радянського дизайну типу ВВЕР. Це найбільший парк таких реакторів за межами Росії, котра, як відомо, оголосила себе наступницею СРСР. Якщо в РФ експлуатуються дев’ять енергоблоків із реакторами ВВЕР-1000 і шість реакторів типу ВВЕР-440, то в Україні ВВЕР-1000 налічується аж 13 штук плюс два енергоблоки з реакторами типу ВВЕР-440. Як написано в звіті компанії «ТВЕЛ» за минулий рік, її виручка за підсумками 2008 року за рахунок поставок ядерного палива на АЕС України і Вірменії (там експлуатується лише один енергоблок із реактором ВВЕ-440) становила 15944 млн. руб. (34,4% загальної виручки). Стільки ж коштів було отримано від поставок на всі російські АЕС із загальною кількістю енергоблоків 31, включаючи реактори іншої конструкції. Тобто за кількості енергоблоків, яка вдвічі перевищує кількість українських, ВАТ «ТВЕЛ» на внутрішньоросійському ринку одержує таку саму виручку за рік, як від України.

Для ілюстрації значущості українського ринку не зайвим буде навести й деякі інші цифри. Продаж ядерного палива компанією «ТВЕЛ» на АЕС Східної Європи і Литви в 2008 року дав 21,2% виручки, АЕС Китаю — 2,7, АЕС Індії — 5,7, АЕС Ірану — 1,7%. Якщо порівняти ці цифри, то виходить, що Україна забезпечує половину валютної виручки російського «ТВЕЛ».

Зрозуміло, що основне завдання російської сторони — будь-яким способом зберегти для себе величезний ринок ядерного палива України, витіснивши конкурента — Westinghouse Electric Company, основним акціонером якої є Toshiba. Як відомо, компанія Westinghouse навесні 2008 року підписала контракт із НАЕК «Енергоатом» на п’ять років (із 2011-го по 2016 рік) на поставку ядерного палива для трьох реакторів ВВЕР-1000 Южно-Української АЕС.

Нині частка Westinghouse на світовому ринку ядерного палива становить 26%, частка компанії «ТВЕЛ» — 17. Отже, «ТВЕЛ» ставить собі за мету завоювати 30% світового ринку ядерного палива до 2030 року. Для її досягнення необхідно не тільки зберегти наявні ринки, а й збільшити їх з урахуванням планів, наприклад, тієї самої України щодо будівництва нових атомних енергоблоків. Звідси і наміри Росії створити такі умови, за яких Україна, обравши російські технології для заводу з фабрикації ядерного палива на своїй території, згодом будувала б тільки енергоблоки з реакторами російського виробництва. У цьому разі російські компанії практично навічно закріплюються в Україні, а ми потрапляємо в 100-відсоткову залежність від російських технологій у ядерній енергетиці як мінімум до 2100 року. А монополізм через відсутність конкуренції призводить до диктату цін виробника, нав’язування невигідних умов для споживача товарів і послуг. І найстрашніше, як ми переконалися на прикладі «газових війн», у випадку політичних ускладнень між нашими країнами монополіст може «перекрити кран», приміром, призупинити поставку ядерного палива. І тоді наші атомні станції, які виробляють майже 50% електроенергії в Україні, зупиняться. Економіка країни зруйнується, а українські громадяни змушені будуть використовувати досвід предків життя при каганці.

Національні інтереси України в цій сфері чітко прописані в Енергетичній стратегії до 2030 року, затвердженій урядом навесні 2006 року. Насамперед це позбавлення від 100-відсоткової залежності від монопольного російського постачальника ядерного палива на діючі українські АЕС, тобто диверсифікація джерел поставок палива. Щоб досягти цієї мети, у 2005 році був започаткований проект кваліфікації ядерного палива виробництва компанії Westinghouse (його дослідно-промислова експлуатація) і підписаний з нею комерційний контракт у 2008 році.

Друге — диверсифікація реакторних технологій для нового будівництва ядерних енергоблоків в Україні, що передбачає і використання для них палива іншої конструкції та іншого постачальника. Для цього були розпочаті переговори з найбільшими постачальниками реакторних технологій — компаніями з Південної Кореї, Канади; із тією ж Westinghouse, французькою AREVA.

Третє — створення елементів ядерно-паливного циклу для задоволення 100% потреб своїх АЕС в урані та цирконієвих сплавах, необхідних для виробництва ядерного палива з умовою купівлі послуг з ізотопного збагачення урану на світових ринках. Будівництво на території України заводу для фабрикації ядерного палива також розглядається як шлях до диверсифікації джерел поставок палива.

Знаючи про це, росіяни пропонують: «При реализации Плана особое внимание должно быть обращено на то, что:

Долгосрочный контракт и противодействие сооружению в Украине завода по технологиям Westinghouse, вне зависимости от стратегии и тактики дальнейших действий, должны оставаться приоритетными задачами российской атомной отрасли в Украине. От их выполнения будет напрямую зависеть объем дальнейшего присутствия Госкорпорации «Росатом» на украинском и европейском рынках. В ином случае, ситуация будет позволять американской компании Westinghouse закрепиться в Украине, а также создать хороший плацдарм для возврата в Европу, где потери для российской атомной отрасли могут быть значительными».

Для розширення своїх можливостей з доступу до послуг зі збагачення урану уряд України прийняв рішення про приєднання до роботи Міжнародного центру зі збагачення урану (МЦЗУ) у російському Ангарську. Діяльність цього центру, як голосно заявляла російська сторона, відбуватиметься під егідою Міжнародного агентства з атомної енергії (МАГАТЕ) і гарантуватиме доступ країн-учасниць до одержання збагаченого урану, необхідного для виробництва ядерного палива для своїх АЕС.

Виходить, що завдання в РФ і України спільне (див. епіграф) тільки в одному — в обстоюванні кожною власних національних інтересів при розвитку вітчизняних ядерної енергетики та атомно-промислового комплексу. А от інтереси національні при цьому зовсім не збігаються і навіть багато в чому, як-то кажуть, перпендикулярні.

Методи «понуждения» до співробітництва

Методи обстоювання своїх національних інтересів, причому в усіх сферах, росіяни використовують найрізноманітніші: від «подключения политического ресурса России», як гарно написано у вищезгаданому плані, до залучення маргінальних проросійських партій в Україні, про що, правда, у «Плане мероприятий… при неподписании…» прямо не написано. Від тиску на Україну через комерційні інструменти, авторитет Євросоюзу до шантажу виходом із переговорів і демонстративною активізацією їх з іншими державами про будівництво заводу з виробництва ядерного палива. Ну, і само собою, публікація і тиражування в російських, українських та інших ЗМІ коментарів політиків і експертів про те, що в зриві терміну підписання контракту між українським «Енергоатомом» і російським «ТВЕЛом» винна Україна.

Автори, а потім і виконавці «Плана...» не гребували тим, що використовували некоректні прийоми. Наприклад, поширюючи інформацію про те, що експлуатація палива виробництва Westinghouse призведе до другого Чорнобиля. Або запускаючи «качок» у ЗМІ, що вже прийнято рішення в секретаріаті президента України про розміщення заводу для фабрикації ядерного палива поруч із Білою Церквою, де нещодавно відбулися протести жителів із приводу розміщення іншого промислового об’єкта. В арсеналі прийомів і організація різноманітних мітингів-протестів із використанням українських громадян.

Збагатитися на збагаченні

«Критической точкой для Госкорпорации «Росатом» является 2015 год, когда по оценкам Украиной будет приниматься окончательное решение о дальнейшей работе с американской компанией. Очень важно преодолеть этот год в рамках долгосрочного сотрудничества. Ограничение срока действия контракта 2015 годом будет способствовать созданию комфортных условий для экспансии Westinghouse на рынок ВВЭР. Необходимо учитывать то, что примерно в это же время ожидается выход на проектные мощности (или, как минимум, пуск первых очередей) новых разделительных предприятий в Европе и США. Избыток производственных мощностей, превышение предложения над спросом и отсутствие долгосрочного контракта на комплектные поставки могут привести к тому, что Украина осуществит долгосрочную диверсификацию поставок услуг по изотопному обогащению урана».

Из «Плана мероприятий Госкорпорации «Росатом» по действиям в отношении Украины после 15 июля 2009 года при неподписании долгосрочного контракта на поставку топлива после 2010 года»

В ідеалі, контракт із «ТВЕЛ» на поставку ядерного палива для українських АЕС треба було б підписувати НАЕК «Енергоатом» на строк із 2011-го по 2015 рік. Спочатку росіяни пропонували терміни контракту з 2011-го по 2026 рік. За останньою інформацією, було знайдено компроміс — термін контракту обмежується 2020 роком. І якщо часові рамки контракту залишаться саме такими, то росіян можна буде привітати з досягненням однієї з цілей.

Для РФ важливо подолати фатальний 2015 рік у рамках довгострокового співробітництва з Україною, про що й записано в документі, який ми розбираємо. Саме цей рік стане тим рубежем, коли в Україні буде прийнято рішення про промислову експлуатацію тепловидільних збірок виробництва Westinghouse після завершення чотирирічного терміну дослідної експлуатації 42 ТВЗ і проходження дозвільних процедур у Держкомітеті ядерного регулювання України. Тобто з’явиться реальний шанс, що Україна одержить другого постачальника ядерного палива для своїх АЕС, і буде досягнуто визначеної в Енергетичній стратегії мети щодо диверсифікації джерел поставок.

Справа ще й у тому, що до 2015 року мають бути введені в експлуатацію додаткові потужності зі збагачення урану у Франції та США, і Україна зможе закуповувати ці послуги на світовому ринку для збагачення видобутого вітчизняного урану, оскільки пропозиція на цю послугу, як справедливо зазначають автори російського плану, перевищить на той час попит, і ціна на збагачення може істотно знизитися через конкуренцію на ринку цих послуг.

До сьогодні всі послуги зі збагачення урану закупалися НАЕК «Енергоатом» тільки в РФ, зокрема і для збагачення урану на комерційній основі для виготовлення 42 ТВЗ виробництва Westinghouse, які вже є в Україні. Тому не дивно, що серед цілей горезвісного плану й значиться «создание условий для невозможности прямых закупок» послуг з ізотопного збагачення урану через дочірню компанію «Росатому» ВАТ «Техснабэкспорт». Суворо обумовлено: поставки Україні тільки у вигляді готових ТВЗ, тобто комплектні поставки, і тільки через «ТВЕЛ». Росіяни цього разу не хочуть допустити конкуренції власних компаній на українському ринку, оскільки «Техснабэкспорт» свого часу виграв тендер на збагачення українського урану, необхідного для фабрикації вищезгаданих ТВЗ виробництва Westinghouse. РФ вигідно продавати продукцію вищої технологічної переробки, тобто готові ТВЗ через «ТВЕЛ».

У зв’язку з цим примітно й те, що, попри всі формальні кроки, розпочаті Україною для приєднання до Міжнародного центру зі збагачення урану, рішення щодо неї ще не прийнято, хоча минуло вже майже десять місяців після відповідної української ноти. Російська сторона киває на Казахстан — третього учасника МЦЗУ. Та є підстави припускати, що саме на прохання РФ Казахстан ніяк не може «дати добро» на участь України в цьому проекті.

Росії дуже вигідний «підвішений» стан України в цьому питанні, щоб, наприклад, висувати умови про закупівлю всього обсягу послуг зі збагачення урану тільки в неї з 2011 року і на наступні мінімум десять років.

Та є нюанс. Оскільки Росія стала ініціатором створення МЦЗУ і дуже пишається, що перша з держав — учасниць МАГАТЕ реалізує так звані багатосторонні підходи до чутливих з погляду розповсюдження ядерної зброї стадій ядерно-паливного циклу, запропоновані свого часу МАГАТЕ, то буде якось негарно виглядати в очах міжнародної громадськості, якщо РФ відкрито гальмуватиме процес входження України в цей проект. Краще зробити це чужими руками, що після арешту керівника «Казатомпрому» М.Джакішева виявилося зовсім неважко, адже тепер цю казахстанську атомну компанію очолює людина з родинними зв’язками в російському атомно-промисловому комплексі (В.Школьник є тестем В.Живова, керівника російської компанії «Атомредметзолото», котрий, як пише преса, «зовсім випадково» відповідає в «Росатомі» за контакти з «Казатомпромом»).

І чи потрібно Україні входити в цей проект, якщо і його РФ збирається використовувати як інструмент тиску? Потенційні партнери проекту і МАГАТЕ! Уважно прочитайте таку цитату з плану:

«4.2. Информирование украинской стороны о бизнес-модели ОАО «МЦОУ»:

— ОАО «МЦОУ» не является коммерческой организацией, предоставляющей услуги по обогащению урана по долгосрочным контрактам;

— ОАО «МЦОУ» — гарант предоставления ЕРР, который не имеет собственных производственных разделительных мощностей, но имеет определенные возможности в рамках выделенных квот на реализацию ежегодных спотовых заказов.

4.3. После присоединения Украины к ОАО «МЦОУ» предоставление ГП НАЭК «Энергоатом» услуг ОАО «МЦОУ» в объеме, который не будет превышать потребности в ЕРР трех украинских энергоблоков, фабрикацию для которых будет осуществлять нероссийский поставщик. Создание для Украины максимально жестких условий приобретения ЕРР в составе ОУП ОАО «МЦОУ» — заблаговременная заявка на получение услуг, мировые цены на услуги по обогащению урана. Прямая поставка ЕРР в составе ОУП в Украину должна осуществляться только через ОАО «МЦОУ» ввиду политического решения о присоединении Украины к данной организации. Прямые поставки ЕРРОУП от ОАО «Техснабэкспорт» в Украину должны рассматриваться как наихудший вариант».

Завод з фабрикації ядерного палива в Україні — неприхований шантаж

«Раздел 2. Мероприятия, связанные с выходом ОАО «ТВЭЛ» из переговорного процесса.

2.1. После информирования украинской стороны о выходе ОАО «ТВЭЛ» из переговорного процесса до перевода вопроса обеспечения АЭС Украины ядерным топливом в коммерческую плоскость, сосредоточить внимание на переговорах с чешскими партнерами по вопросу размещения «пилотного» регионального завода в Чехии, а также на контактах с другими зарубежными игроками на мировом рынке ядерного топлива с целью создания дополнительных зон давления на Украину.

Риски для Украины: неполучение топлива в 2011 году, отказ от вовлечения украинского урана в производство ТВС до подписания долгосрочного контракта, корректировка срока ввода в эксплуатацию производства ядерного топлива.

Риски для Госкорпорации «Росатом», ОАО «Атомэнергопром» и ОАО «ТВЭЛ»: отсутствие подтвержденного заказа на закупку урана, услуг по обогащению и на фабрикацию, невыполнение КПЭ в части формирования портфеля экспортных заказов на пятилетний период, вероятность расширения присутствия Westinghouse в Украине по политическим мотивам, закупка нероссийского урана и ЕРР минимум для трех энергоблоков.

Варианты создания дополнительных зон давления на Украину во время паузы в переговорах:

2.1.1. Продолжение переговоров с чешскими партнерами по сооружению производства ядерного топлива по российским технологиям в Чехии. Прояснение ситуации о желании и возможностях чешской стороны разместить сборочное производство ТВС по российским технологиям на своей территории. Обсуждение вопроса о возможности оказания давления со стороны Европейского Союза на Украину для принятия ею чешского производства в качестве альтернативного производителя и поставщика ядерного топлива. Проработка вопроса касательно возможности понуждения Украины со стороны ЕС к обязательному проведению тендеров при закупке ядерного топлива.

2.1.2. При возврате российской стороны к переговорному процессу с Украиной по долгосрочному контракту, по согласованию с чешской стороной, информирование Украины о том, что затягивание переговорного процесса с ее стороны привело к окончательному выбору нами Чехии в качестве площадки для размещения «пилотного» завода по производству топлива по российским технологиям. Предлагаем Украине принять этот завод в качестве альтернативного поставщика топлива для украинских АЭС. Обсуждение вопроса закупок Украиной топлива на тендерной основе.

2.1.3. Проведение переговоров с Toshiba/Westinghouse по вопросу о возможности кооперации по фабрикации топлива. Использование сотрудничества ОАО «Атомэнергопром» с Toshiba по организации склада ОУП для начала кооперации с Westinghouse. Использование фактора гарантированного обеспечения Toshiba/Westinghouse российским ОУП для размена на уход американской компании с рынка ядерного топлива Украины.

2.1.4. Проведение встречи с GE по вопросу кооперации в части совместного бизнеса по продвижению ТВС — Квадрат на американский рынок. Использование контактов как угрозу для позиций Westinghouse в США.

2.1.5. Проведение переговоров с Siemens и использование стратегического альянса для выхода на американский рынок с целью оказания давления на Westinghouse.

2.1.6. Рассмотрение возможностей использования сотрудничества с американской компанией USEC по поставкам российских услуг по обогащению урана для давления на Westinghouse».

«План мероприятий Госкорпорации «Росатом» по действиям в отношении Украины после 15 июля 2009 года при неподписании долгосрочного контракта на поставку топлива после 2010 года».

Були часи, коли пан В.Константинов, один із керівників «ТВЕЛ», казав, що Росія тільки тоді будуватиме заводи з фабрикації ядерного палива на чужій території, коли парк російських реакторів у світі досягне цифри 90. А поки що їх у світі налічується 74. Та раптом минулої осені компанія «ТВЕЛ» публічно сформулювала вимоги до вибору майданчика для будівництва заводу за межами Росії.

Майданчик вибирається на підставі таких критеріїв, яким мають відповідати країни: наявність великого парку реакторів російського дизайну, прихильність у перспективі до російських технологій, рівновіддаленість від традиційних російських ринків збуту продукції ядерного паливного циклу.

Виходить, що Україна відповідає першому оголошеному критерію (максимальна кількість реакторів за межами РФ). Що ж до другого, то, судячи з усього, прем’єр-міністр України запевнила свого російського колегу в «прихильності в майбутньому» до російських технологій. Незрозуміло тільки, як бути з третім критерієм, оскільки Україна сьогодні є центром ринку збуту продукції російського ядерно-паливного комплексу за обсягами й тому не може бути «рівновіддалена» від традиційних російських ринків за визначенням.

Для вчинення тиску на Україну керівництво «ТВЕЛ» у червні—липні стало роздавати інтерв’ю ЗМІ про те, що «по крайней мере пять стран уже высказали заинтересованность в строительстве таких заводов. Мы внимательно смотрим и увязываем окончательное решение с разработанными нами критериями». Серед можливих партнерів називалися такі держави, як Чехія (два енергоблоки з реакторами ВВЕР-1000 і чотири з реакторами ВВЕР-440), Словаччина (п’ять блоків із реакторами ВВЕР-440). Під іншими, найшвидше, малися на увазі (але не називалися) Угорщина (чотири реактори типу ВВЕР-440), Болгарія (два енергоблоки з реакторами типу ВВЕР-1000, будуються ще два аналогічні). Можливо, для круглого числа малася на увазі й Фінляндія, яка експлуатує два енергоблоки типу ВВЕР-440.

Неузгодженість у тому, що в цих країнах експлуатуються переважно російські реактори першого покоління, які незабаром виводитимуться з експлуатації. А ТВЗ для них за конструкцією відрізняється від ТВЗ для реакторів ВВЕР-1000, які РФ активно просуває за кордоном. Щось не сходиться тут з оголошеним критерієм за кількістю енергоблоків російського проекту, особливо останнього покоління. Всі ці розмови про чергу з охочих будувати завод — чистої води блеф і надування щік.

А от українські експерти вважають, що в стратегічному плані більш перспективним для майбутнього ядерної енергетики в Україні буде будівництво заводу для фабрикації ядерного палива в партнерстві з компанією Westinghouse.

По-перше, ця компанія володіє технологією виробництва палива для реакторів ВВЕР-1000, що дасть змогу, у разі реалізації проекту, забезпечити діючі українські АЕС паливом власної фабрикації. За винятком двох енергоблоків — РАЕС-4 і ХАЕС-2, оскільки за часів уряду Януковича було підписано контракти з ВАТ «ТВЕЛ» на поставку ядерного палива на ці блоки на весь термін їхньої експлуатації, а це мінімум 30 років. По-друге, вона є найбільшим постачальником ядерного палива на ринки США та Західної Європи, оскільки володіє технологіями виробництва палива для всіх типів легководяних реакторів: водо-водяних під тиском (тип PWR), киплячих (тип BWR), загальна кількість яких у світі становить 216. Більш того, у перспективних планах багатьох країн — переважне будівництво реакторів типу PWR, що значно збільшить цей сегмент ринку ядерного палива.

У разі досягнення відповідних домовленостей можна було б виробляти в Україні паливо й для реакторів західного дизайну та вийти разом із Westinghouse на світовий ринок. Щось схоже планує Казахстан, створивши спільне підприємство з французькою AREVA. За планами, французька компанія забезпечить технічну підтримку створення виробництва палива на Ульбінському металургійному комбінаті потужністю 1200 тонн урану на рік, при цьому буде окрема лінія для виробництва палива для реакторів французького дизайну в обсязі 400 тонн урану на рік. А решта виробничих потужностей — 800 тонн урану на рік — використовуватимуться для виробництва палива для реакторів іншого дизайну.

Втім, і в цьому питанні російським планом передбачено «профілактичні» заходи. Та вже із тиску на компанію Westinghouse. Цьому присвячено чотири заходи. Наприклад, «проведение переговоров с Toshiba/Westinghouse по вопросу о возможности кооперации по фабрикации топлива. Использование сотрудничества ОАО «Атомэнергопром» с Toshiba по организации склада ОУП для начала кооперации с Westinghouse. Использование фактора гарантированного обеспечения Toshiba/Westinghouse российским ОУП для размена на уход американской компании с рынка ядерного топлива Украины». Інші пункти «Плана…» стосуються використання контактів і переговорів із компаніями, у тому числі з американськими General Electric, USEC і Simens, «как угрозу для позиций Westinghouse в США».

Сьогоднішню вичікувальну позицію Westinghouse щодо співробітництва в будівництві заводу з фабрикації ядерного палива в Україні можна пояснити тільки успішною реалізацією згаданих пунктів російського плану (термін реалізації був запланований на липень—серпень 2009 року).

Російські погрози та українські відповіді

Ну і, звичайно, в арсеналі інструментів тиску РФ на Україну набір погроз: не поставляти ядерне паливо після 2011 року; створити умови, щоб у 2010 році в рамках дії старого контракту Україна не змогла зробити резерв свіжого палива для використання його в 2011 році, для чого вимагати 100-відсоткової передоплати за 150 днів до його відвантаження; відмовитися від купівлі 200 тонн українського уранового концентрату в 2009-му і 2010 році, створити «максимально жесткие условия» придбання нею (Україною. — О.К.) послуг зі збагачення урану в складі «МЦЗУ», а саме: «заблаговременная заявка на получение услуг, мировые цены на услуги».

Хочу звернути увагу й на такі перли, що містяться в документі: «…о возможности оказания давления со стороны Европейского Союза на Украину для принятия ею чешского производства в качестве альтернативного производителя и поставщика ядерного топлива». Ну і також «касательно возможности понуждения (!) Украины со стороны ЕС к обязательному проведению тендеров при закупке ядерного топлива».

Цікаво, яким чином ЄС буде «понуждать» Україну до проведення тендерів із закупівлі палива, якщо нашим національним законодавством із закупівель саме для свіжого ядерного палива через його специфічність як товару зроблено виняток?

Судячи з висловлювань прем’єр-міністра України, наведених на початку статті, вона підтримує росіян у комплексному ув’язуванні питання та готова до тісного співробітництва в ядерній галузі на їхніх умовах.

Президент України, однак, побачив у російській умові закупівлі Україною всього обсягу послуг зі збагачення урану загрозу монополізації, про що сказав 5 червня, відкриваючи засідання РНБОУ, присвячене розвитку ринку паливно-енергетичних ресурсів у рамках реалізації Енергетичної стратегії України. Указ президента, яким введено в дію рішення РНБО, був оприлюднений тільки 27 серпня. Таку повільність важко пояснити у світлі непростих і важливих із погляду майбутнього розвитку вітчизняного ядерної енергетики переговорів, які тривають увесь цей час.

У рішенні РНБО чітко сформульовано, що при складанні контрактів на поставки ядерного палива необхідно «уникати прийняття умов, які обмежують можливості України в диверсифікації джерел поставок ядерного палива і монополізують окремі послуги ядерно-паливного циклу». З’явилося і дещо нове. Уряду доручено до кінця 2009 року «відпрацювати з урахуванням наявних пропозицій питання створення на конкурсній основі підприємства з виробництва ядерного палива». Раніше про конкурс не йшлося, говорили лише про вибір партнера.

Ну й зовсім уже дивним виглядає в цьому рішенні доручення уряду: «Розробити в місячний термін (!) проект міжурядової угоди з Урядом РФ щодо розвитку співробітництва в галузі розвідки, видобутку та переробки уранових руд, спрямованої на забезпечення в середньостроковій перспективі видобутку урану для повного покриття потреб ядерної енергетики України в урановій сировині».

Чого раптом, як кажуть в Одесі? Як це доручення поєднується з побоюваннями президента щодо монополізації Росією окремих стадій ядерно-паливного циклу, мабуть, відомо тільки тим, хто готував текст указу. Чому договір потрібно підписувати саме з Росією, а не з Казахстаном, Канадою, Австралією, нарешті, які є світовими лідерами з видобутку та переробки урану і створюють спільні підприємства по всьому світі?

А до всього цього, дорогі читачі, побачив світ указ президента від 11 лютого 2009 року, де чорним по білому було написано: «...незважаючи на успішно проведені переговори під керівництвом глави держави з американською стороною і підписання контрактів із компанією Westinghouse на поставки ядерного палива на три атомні станції, починаючи з 2011 року…» Тобто наш шановний президент розписався в тому, що він втрутився у компетенцію уряду України і вів переговори від імені суб’єкта господарювання НАЕК «Енергоатом»? Ну що тут скажеш...

А тепер уявіть, як за такої, м’яко кажучи, плутанини, що панує у найвищих ешелонах української влади, суб’єкт господарювання, а саме — державне підприємство НАЕК «Енергоатом», може адекватно вести виснажливі переговори з російськими партнерами, відомими своєю майстерністю і витонченістю, котрі до того ж мають затверджений план «понуждения»? І домагатися при цьому захисту національних інтересів України?

P.S. У 2003 році президент України Леонід Кучма подарував на день народження президенту РФ Володимирові Путіну каміновий годинник, на якому був напис із цитатою І.Канта: «Две вещи на свете наполняют мою душу священным трепетом: звездное небо над головой и нравственный закон внутри нас».

Дотепер переймаюся запитанням: що мав на увазі Леонід Данилович? Намагався наставити молодого колегу на путь істинний, аби той орієнтувався на моральні закони і пам’ятав про вічне? На жаль, не в коня корм, як кажуть. Порівняйте наведені в епіграфі слова російського прем’єра «о взаимоприемлемости» підходів і відповідальності за «сохранение капитала сотрудничества» із суттю «Плана мероприятий… при неподписании…»
