Demjanjuk's lawyer again seeks release

MUNICH -- John Demjanjuk's lawyer has sought again the release of the 90-year-old defendant from custody at his trial in Germany.

The retired Ohio autoworker faces 28,060 counts of accessory to murder for his alleged activities as a guard at the Nazis' Sobibor death camp. Demjanjuk denies ever being a guard anywhere.

Ulrich Busch argued at the Munich state court Tuesday that it lacked jurisdiction over the case and that Sobibor charges already were considered during Demjanjuk's earlier trial in Israel.

He also argues it is disproportionate to keep Demjanjuk in prison given his poor health.

Court doctor Albrecht Stein said Demjanjuk was suffering from low hemoglobin and would have a blood transfusion later Tuesday.
